EnderHost Terms of Service

Please read these terms of service carefully before using our service. They outline the rules and regulations for the use of our services and products. Do not order a product or service if you do not agree with the terms and conditions outlined below.

1. Introduction

Welcome to EnderHost! By using our services, you agree to comply with and be bound by the following terms and conditions. Please review them carefully. If you do not agree to these terms, you should not use our services.

2. Services Provided

EnderHost offers Minecraft and game hosting services. These services include, but are not limited to, server rental, maintenance, and support.

3. Eligibility

EnderHost cannot allow users in the following circumstances:
a) Under the age of 13.
b) Under the age of 18 without parental/legal guardian consent.
c) Barred from receiving services under applicable law.
d) Suspended from using the Site.
e) Lacking valid communication with the website.
f) Flagged by our Anti-Fraud system.
g) Listed on prohibited or restricted parties lists by authorities.

EnderHost reserves the right to modify or replace any part of this Agreement at its sole discretion, with or without notice. Your continued use of or access to our services following the posting of any changes constitutes acceptance of those changes. Check these terms regularly to stay updated.

7. Indemnification and Refusal of Service

You agree to indemnify and hold EnderHost, its employees, and associates harmless from any claims, liabilities, or expenses arising from your use of our services. We reserve the right to refuse, cancel, or terminate services at our discretion for any violations of our terms, policies, or unlawful activities. Refunds will not be issued for terminated accounts due to policy violations.

Location-Specific Policies
EnderHost offers colocation services in multiple data centers. Please note that policies, remote hands rates, and de-racking fees may vary depending on the facility. All location-specific pricing and procedures are outlined below.

Dallas Colocation
Access to the data center is restricted to Clients who have purchased half rack and above colocation services. Clients are responsible for the maintenance, setup, and configuration of their own equipment. We aren ot liable for hardware failures or losses related to the Client's equipment. Access to the datacenter is by appointment only and must follow our security protocols at all times. We gaurantee the availability of power and network connectivity as specified in the Client's agreement.
Free Remote Hands (Dallas):Remote Hands Rates (Dallas):Deracking Fee (Dallas): $125 one-time fee per server — does not include packing materials or shipping labels. Requests must be made through the designated support channels.

Chicago Colocation
All Chicago colocation clients must ensure all invoices are fully paid before equipment can be returned in the event of cancellation. Remote hands services are billed at a rate of $265/hr, billed in 15-minute increments ($66.25 per 15 minutes). EnderHost reserves the right to adjust remote hands fees depending on the requested action.

In the event of cancellation, clients will be charged a de-racking and shipping fee of $265/hr, billed in 15-minute increments ($66.25 per 15 minutes). Packaging materials are available upon request but subject to availability. Clients may provide their own shipping labels or request that EnderHost provide one, in which case the cost will be added to the de-racking fee.

If a colocation service is cancelled or terminated, clients must immediately remove all equipment from the assigned colocation space. If equipment is not removed within 30 days of service termination, it will be considered abandoned. EnderHost reserves the right to remove, discard, and/or liquidate abandoned equipment. Any proceeds from liquidation will be applied to the client's outstanding balance.

EnderHost is not responsible for any damage caused to client hardware while housed at the data center or during shipment.

Backups are taken every 24 hours for up to 7 days and stored offsite, accessible by opening a support ticket. However, we are not responsible for any data loss or unavailability of backups, and the user agrees to hold EnderHost harmless from any liability related to such data loss or unavailability. Backups created by users through the Game Panel are retained for up to 30 days. After this period, they may be automatically removed. EnderHost reserves the right to delete expired backups at its discretion.

22. Governing Law and Jurisdiction

These Terms of Service shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles. Any legal suit, action, or proceeding arising out of or related to these Terms of Service shall be instituted exclusively in the courts of the State of Florida. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.

23. Limitation of Liability

EnderHost is not liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to loss of profits, goodwill, use, data, tangible or intangible losses.
